General Terms and Conditions (GTC) – Thraki GmbH, Switzerland
1 Scope
These GTC apply to all orders placed through our online store by consumers and business customers. Consumer: a natural person who enters into a legal transaction for private purposes. Business customer: a natural or legal person who enters into a legal transaction in the exercise of their commercial or independent professional activity. Conflicting terms and conditions of a business customer only apply if we agree to them in writing.
2 Contracting party, conclusion of the contract
Purchase contract with: Thraki GmbH, Gaswerkstrasse 2, 8952 Schlieren, Switzerland. The presentation of products is non-binding. Orders can only be placed with a customer account. By clicking the order button, you place a binding order. The conclusion of the contract depends on the payment method. Invoice: acceptance by email or by delivery within 5–7 days. Prepayment: acceptance by email containing bank details, delivery after receipt of payment. Cash payment on pickup: acceptance by email, payment on pickup or in advance.
3 Contract language, storage of the contract text
Language: German. The contract text and the GTC are stored in the customer account and sent by email.
4 Delivery terms
Shipping costs: see product description. Pickup is possible at Gaswerkstrasse 2, 8952 Schlieren, Mon–Fri: 6:00 am – 5:00 pm, Saturday: 6:00 am – 3:00 pm. No delivery to parcel lockers (Packstation).
5 Payment
Payment methods: credit card or PayPal.
6 Retention of title
The goods remain the property of Thraki GmbH until full payment. Business customers may resell goods subject to retention of title; they assign to us the claims arising from such resale.
7 Transport damage
Report any obvious damage to the delivery service immediately and inform us. Statutory warranty rights remain unaffected.
8 Warranty and guarantees
Consumers: statutory liability for defects applies. Business customers: 1-year warranty for new items, excluded for used items. Liability is limited, except in cases of injury to life, body or health, intentional or grossly negligent breach of duty, or a guarantee commitment.
9 Liability
In cases of slight negligence, liability is limited to foreseeable damage. We accept no liability for the content of external links.
10 Dispute resolution
We do not participate in conciliation procedures. Place of jurisdiction for merchants and legal entities under public law: Schlieren, Switzerland.
11 Protection of minors
We assume that all customers are at least 18 years old. Orders from minors are not permitted.
12 Final provisions
Applicable law: Swiss law. Place of jurisdiction: Schlieren, Switzerland, for merchants, legal entities under public law and special funds under public law. We reserve the right to amend these GTC; the current version is available on the website.
